Terms and Conditions

These Terms & Conditions ("Terms") govern the sale of products and services by Shower Haus and your use of our website at www.showerhaus.co.za (the "website"). Please read them carefully. By placing an order with us, you agree to these Terms.

1. Who we are

In these Terms, "Shower Haus", "we", "us" and "our" refer to Showerhaus KZN (Pty) Ltd. The address above is also the address at which we will accept service of legal documents.

2. Definitions

  • Customer / you — the person or business purchasing products or services from us.
  • Products — the shower doors, enclosures, screens, spares, and accessories we supply.
  • Standard Range — products available in standard sizes.
  • Custom-Made — products manufactured specifically for your space and measurements.
  • Shower Solution — the complete outcome, which may include products and installation.
  • Installation — our fitting of a Shower Solution at your site.
  • Quote — a written quotation we issue for products and/or installation.
  • Order — your request to purchase products or services, whether placed online or through a Quote.

3. About these Terms

These Terms apply to every order. They work alongside our other policies, each of which applies where relevant: our Using Our Website policy, Shipping and Delivery Policy, Refund and Returns Policy, Privacy & POPI Policy, Cookies Policy, and PAIA Policy. Where these Terms conflict with one of those policies in relation to a sale, these Terms apply.

We may update these Terms from time to time. The version that applies to your order is the one published on the website when you place it.

4. Your account

You may create an account to place orders and manage your details. You are responsible for keeping your account details secure and for activity that takes place under your account. Accounts are personal to you and are not transferable. Please contact us if you believe your account has been used without your permission.

5. Products and services

We design, supply, and install standard and custom-made shower solutions, and we sell shower spares and accessories. We take care to describe our products accurately, but the information on the website is a guide — please see clause 8 and our Using Our Website policy regarding the accuracy of website information, on-screen colours, and specifications.

6. Quotes and site measurement

Custom-made work is quoted on measurements taken at your site by our representative. So that we can measure accurately, the following must be complete before our measurement visit:

  • all tiling within the shower; and
  • any other work that would affect the final size of the shower glass.

A Quote is valid for the period stated on it. It is based on the information and measurements available when we issue it, and may be adjusted if those details change, if the site differs from what was described, or if you change the specification.

7. Placing and accepting an order

The display of products and prices on the website is an invitation to do business, not an offer. When you place an order — online or by accepting a Quote — you are making an offer to buy.

A binding contract is formed only when we confirm acceptance of your order, by written confirmation or by beginning to fulfil it. Until then, we may decline or be unable to fulfil an order — for example, where a product is unavailable, where we cannot carry out the installation, or where the order was placed at a price affected by an obvious error (see clause 8). If we cannot accept your order, we will tell you and refund any payment already made for it.

8. Pricing, VAT and errors

Prices are in South African Rand and include VAT unless stated otherwise. Pricing for custom work is set out in your Quote.

We take care with our pricing and product information, but errors can occur, and the website may contain inaccuracies. Where a price or other detail is incorrect because of an obvious or inadvertent error, we are not bound by it. If an error affects an order you have placed, we will contact you before processing it so that you can choose to continue at the correct price or details, or cancel and receive a refund of anything paid. Nothing in this clause affects your rights under the Consumer Protection Act.

9. Payment and deposits

Payment on the website is processed securely through our payment gateway, Peach Payments. We do not store your card details.

Standard Range products, spares and accessories are paid for in full at the time of order.

Custom-made shower solutions are paid in three stages:

  • 50% deposit before we begin manufacturing;
  • 40% before installation; and
  • 10% once installation is complete.

You may choose to pay any outstanding amount earlier, or pay in full at any stage, if that is simpler for you. We begin manufacturing only once the deposit is received, and we schedule installation only once the second payment is received.

10. Delivery

Delivery timing and arrangements are set out in our Shipping and Delivery Policy. Custom-made products are delivered as part of the installation arranged with you.

11. Installation

A standard installation covers the fitting of the products we supply — your shower door, enclosure, or screen — including the silicone work that forms part of fitting the product. It does not include any other work, such as tiling, waterproofing, electrical work, plumbing, or making good to surrounding surfaces.

Site readiness. So that we can install correctly and protect the finish of the work, the following must be complete before our installation visit:

  • all tiling within the shower;
  • adjacent flooring;
  • any finishing work involving abrasives, such as sugar soap; and
  • any other work in the same room that creates dust, as dust can adhere to fresh silicone and discolour it.

If the site is not ready. If our team arrives and the site is not ready, we may not be able to carry out the installation, and you may be liable for an additional call-out or installation fee, as the case may be. We will always try to agree a workable arrangement with you first.

12. Changes, cancellations and custom orders

If you want to change an order after it is placed, contact us as soon as possible and we will tell you whether the change is possible and whether it affects the price or timing.

Standard Range products, spares and accessories are governed by our Refund and Returns Policy.

Custom-made products are manufactured specifically for you and your space, and cannot be resold. For this reason, once manufacturing has begun, the 50% deposit is non-refundable if you cancel before installation. This reflects the materials and bespoke manufacturing committed to your order. Custom-made goods are not eligible for the standard online cooling-off right, because they are made to your specification.

13. Guarantees and warranties

We stand behind our work and the products we supply:

  • Workmanship guarantee: we guarantee our installation workmanship for three (3) months from the date installation is completed.
  • Product warranty: the hardware used in your shower is warranted for twelve (12) months from the date of installation or delivery.

These guarantees are in addition to, and do not replace or reduce, the rights you have under the Consumer Protection Act — including the implied warranty of quality, which applies for at least six months regardless of these Terms.

Our guarantees do not cover problems caused by factors outside our control or work, where the cause is shown to be related to the problem, including: the use of detergents or abrasive cleaners; hard-water damage; general misuse or accidental damage; and adjustment, repair, or alteration carried out by anyone other than Shower Haus. 14. Risk and ownership

Risk in the products passes to you on delivery or installation, whichever is first. Ownership of the products passes to you once we have received full payment.

15. Our responsibility to you

We provide our products and services with reasonable care and skill. To the extent permitted by law, we are not liable for loss or damage that is not a foreseeable result of our breach, or that arises from circumstances outside our reasonable control. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability under the Consumer Protection Act.

16. Intellectual property and privacy

All content on the website, and the Shower Haus name and logo, are owned by or licensed to us, as set out in our Using Our Website policy. We handle your personal information in line with our Privacy & POPI Policy.

17. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as supply shortages, transport disruptions, extreme weather, or loss of utilities. If such an event affects your order, we will contact you and agree a way forward.

18. Governing law

These Terms are governed by the laws of South Africa, and any dispute will be dealt with under South African law.

19. General

If any part of these Terms is found to be unenforceable, the rest continues to apply. These Terms, together with your Quote and our other policies, make up the whole agreement between us for your order. We may transfer our rights and obligations under these Terms to another business; your rights are not affected.

20. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on the website, and changes take effect once posted.
